Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pagge platform operated by Pagge Inc. ("Pagge", "we", "us", or "our"), available at pagge.co, and any related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Eligibility
You must be at least 16 years old and capable of entering into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
2. Accounts and Registration
To use the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to keep it updated. You must notify us immediately of any unauthorized use of your account.
3. Description of the Service
Pagge provides tools to create, customize, and publish stores. Depending on your plan, you may be able to publish a limited number of stores, connect a custom domain, and collect orders from your customers. We may modify, suspend, or discontinue any part of the Service at any time with or without notice.
4. Subscriptions, Payments, and Taxes
Certain features of the Service are available on a subscription basis (our "Paid Plans"). By subscribing to a Paid Plan, you agree to pay all applicable fees. Payments for Paid Plans are processed by our Merchant of Record payment providers, Paddle and Lemon Squeezy, who are responsible for collecting and remitting applicable taxes. Prices are shown in your local currency where supported.
Billing and Renewal. Paid Plans are billed in advance on a monthly or yearly basis, as selected at checkout. Subscriptions renew automatically at the end of each billing period until you cancel. You may cancel your subscription at any time from your account billing settings; cancellation takes effect at the end of the current billing period, and you will continue to have access to your plan until then. Unless otherwise required by law, fees are non-refundable except as described in our Refund Policy.
Payment Failure. If a payment is declined or otherwise fails, we may suspend or terminate access to your Paid Plan until the outstanding balance is settled.
5. Free Plan
We may offer a free plan with limited functionality. Free plan availability and features may change at any time. We reserve the right to modify, restrict, or discontinue the free plan in our sole discretion.
6. User Content and License
You retain all rights to the content you submit, upload, or publish through the Service, including product descriptions, images, branding, and customer data ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of providing and operating the Service.
You represent and warrant that you own or have the necessary rights to Your Content and that Your Content does not infringe the rights of any third party, including intellectual property, privacy, and publicity rights.
7. Acceptable Use
You agree not to use the Service to publish or facilitate content that violates any applicable law, infringes third-party rights, or promotes illegal, harmful, deceptive, or otherwise objectionable activity. You must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference.
8. Intellectual Property
The Service, including its software, design, text, graphics, logos, and trademarks, is owned by Pagge and its licensors and is protected by intellectual property laws. Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, or create derivative works from any part of the Service.
9. Termination
You may delete your account at any time by contacting us. We may suspend or terminate your access to the Service, in whole or in part, at our discretion, including if you breach these Terms or violate the Acceptable Use Policy. Upon termination, your right to access and use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections regarding payments, intellectual property, disclaimers, limitation of liability, and indemnification.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
11. Limitation of Liability
To the maximum extent permitted by law, Pagge and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Pagge and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Service, Your Content, or your violation of these Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Pagge Inc. is incorporated, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the competent courts of that jurisdiction. If you are a consumer in the European Economic Area or the United Kingdom, you also have the right to rely on the mandatory consumer protection laws of your country of residence.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or through the Service. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
